Local Laws and Ordinances

1. No person shall construct, maintain, install or enlarge any swimming pool in the Village of Shoreham except in compliance with the provisions of this Ordinance and with the approval of the Suffolk County Health Department.

2. The term "swimming pool" is hereby defined as a receptacle for water, or an artificial pool or water having a depth at any point of more than eighteen inches and a water surface of 75 square feet or more intended for or used for the purpose of bathing or swimming, but such terms shall not be deemed to include portable wading pools located above ground and containing less than 75 square feet of water surface and a depth of less than eighteen inches.

3. No portion of a swimming pool shall be located, built or maintained in a front yard as defined by the Village zoning ordinances nor shall such swimming pool be located, built or maintained closer than fifteen feet from the rear or side property line of the premises.

4. No person shall proceed with the construction, installation, enlargement or alteration of any swimming pool within the Village of Shoreham unless a permit shall first have been obtained from the Village Building Commissioner.

5. An application for such permit shall be accompanied by plot, site and building plans of such swimming pool showing dimensions, design, location and use of all structures, drainage, sanitary, filtration, water supply and disposal facilities, fencing, covering of pool and such other information as may be required by the Building Commissioner. No permit shall be issued unless the Building Commissioner determines that the public health, safety, comfort and welfare will be secure and that such swimming pool will not be detrimental to the general character of the Village of Shoreham.

6. Every swimming pool heretofore or hereafter constructed or maintained shall be completely enclosed by a fence or other structure constructed in such a manner as to prevent persons, including children, from passing through the same. Such fence or other structure shall not be less than four feet in height and shall entirely enclose the area in which the swimming pool is located. All openings or points of entry into the pool area enclosure shall be equipped with gates. All gates shall be equipped with self-closing and self-latching devices placed at the top of the gate and shall be closed at all times when the pool is not in use by the occupant of the premises or his adult guests.

7. All swimming pools shall be provided with two means of egress in the form of steps or ladders. Such steps or ladders shall have a hand rail on both sides.

8. Any person violating any provision of this ordinance shall be subject to a fine not exceeding two hundred and fifty dollars for each offense and in addition thereto such violation shall constitute disorderly conduct and any person violating the same shall be and hereby is declared a disorderly person.

   In the event of the continued violation of this ordinance after notice of such violation, each additional day during which such violation is continued shall constitute a separate offense.
