Local Law 05-01 Parks Regulations Law

A local law creating a chapter of the Code of the Village of Shoreham entitled: “Parks Regulations Local Law” 
Be it enacted by the BOARD OF TRUSTEES OF THE VILLAGE OF SHOREHAM as follows:


Section 1: Title, Purpose, and Definitions 


1.1.(a). Enactment   
Pursuant to Section 10 of the Municipal Home Rule Law, the Village of Shoreham,County of Suffolk, State of New York, hereby amends the Code of the Village of Shoreham to include a new chapter, which shall be this local law No. 05-1. 


1.1(b). Effective Date 
The local law shall take effect twenty calendar days from October 11, 2005, which is the date of this local law’s adoption and filing pursuant to Section 27 of the Municipal Home Rule Law.

1.2 Purpose
The purpose of this local law is to regulate the use of the parkland and other property owned by the Village of Shoreham.

1.3  Definition
 “The Trustees” shall mean the Board of Trustees of the Village of Shoreham.

 

Section 2:  Authorization

The Trustees shall have the authority to adopt and enforce regulations governing the use of all parkland and other property owned by the Village of Shoreham.

 

Section 3:  Enforcement

3.1 Jurisdiction.
The Trustees or their designee shall have jurisdiction for the purpose of either taking remedial action towards any violation of this local law or to prevent the impending or continuing violation of this local law, or to enforce this local law or the intent of this local law, or to prosecute this local law. 
            
3.2 Penalties for Offenses, Separate Offense. 
a.  Any person violating any regulation shall be subject to a penalty for each and every violation. 

b.  The penalty for the violation of a parks regulation shall be not more than five hundred dollars per violation, and a separate offence shall be deemed committed on each day during or on which a violation occurs or continues.
