REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE INCORPORATED VILLAGE OF SHOREHAM HELD IN THE VILLAGE HALL, WOODVILLE ROAD, SHOREHAM, NY ON JULY 8, 2014 AT 7:30 O’CLOCK PM.

Commissioners present: Scrimenti, Kogel, Blum, J.Weiss, along approximately 30 various committee members, chairs and residents, along with reporters from Newsday newspaper.

OPEN MEETING

Mayor Weiss opened the Regular Meeting at 7:30 PM.
Pledge of Allegiance

Mayor Weiss made some preliminary remarks regarding the format the board meetings will have going forward.  The open portion of the meeting will take place immediately after the approval of the minutes.  Residents will have 5 minutes of uninterrupted speaking time.  This period will last roughly 30 minutes if necessary.  The entire meeting will last approximately one and one-half hours.  After the Clerk/Treasurer report, the Board will make a report followed by Commissioner’s reports, and at the end of the meeting the public will have another opportunity for brief comments.

 
NEWLY ELECTED TRUSTEES WERE SWORN INTO OFFICE
Newly elected Board members, Edward Weiss, Mayor, Rosemary Connell and Kathleen Baumann Schnoor were sworn into office immediately preceding the opening of the Board meeting.

MINUTES
Clerk Spier reported that the minutes of the regular June Board of Trustees meeting were reviewed by the Board of Trustees prior to the June 17th election and approved. 

OPEN FORUM
Residents made comments and suggestion to the Board. D.Madigan - relating to renewal of insurance and appraisal of Village Hall, comments on amount of detail on agenda re: abstract, increasing the number of ZBA board members.  M.Madigan - publishing agenda and documents scheduled for discussion on the Village website, publishing log of building permit applications on Village website.   K.Blumer – presentation by Robert Freeman to Village trustees and public relating to Open Meetings Law.

RENTAL REQUEST & RETURN OF SECURITY DEPOSITS
Steward Piscak presented the following for approval:
June 27, 2015 – UL rental - Resident Martin (graduation party) 100 guests 6-11pm $1,500
August 15, 2014 – UL use (only) of bldg. – Guercia (golf dinner open house) under 20 guests during the Friday coffee hour and comprising of all Village residents, no charge.
Return of Security Deposits – Brickley 6/21/14 $764.00 of $1,000; Severance 6/22/14 $250 full return; Kogel 6/28/14 $106 of $250; Schweyer 6/29/14 $156 of $250.

CLERK/TREASURER REPORT
Clerk Spier informed the Board of a written request for permission by resident T. Spier to use the beach on Saturday, July 26, 2014 for approximately 15 people (half of whom would be residents) to land on the beach after kayaking for charity across the sound.  They would arrive at approximately 5:00 and they and their guests would have a celebratory party on the beach with food and drinks.  The Board indicated its approval.

Trustee Vail requested a special meeting on July 29, 2014 for Trustee Schnoor to report on obtaining a bond for roadwork and for Steve Walker to report on new procedures on building permits.  Trustees to confirm availability and Clerk Spier will make necessary postings and publishing of meeting.  Clerk Spier also indicated that the date for the hearing on the local law (below) would take place at the special meeting above.

Clerk Spier read Resolution 12 of June 2014 Introducing Local Law 2 of 2014 Authorizing Alternate Members on the Zoning Board of Appeals.

Resolution 13 – Authorization for Mayor to Sign Refuse Collection Contract with Maggio Sanitation Services commencing August 1, 2014 and expiring July 31, 2018.

Resolution 14 – Authorization for Mayor to Sign Agreement with Brookhaven Town for Receiving Recyclable Materials commencing August 1, 2014 and expiring July 31, 2015.

Resolution 15 – Authorization for Mayor to Sign Extension of Contract with Village Engineer Dan Falasco commencing August 1, 2014 and expiring July 31, 2015
Approved subject to approval by Village Attorney.

Clerk Spier reported that copies of abstracts are available upon request prior to the meeting in compliance with the NYS Open Meeting Law

Financial Report – Treasurer Spier reported that 11 months in to fiscal year – revenues exceed expenses by $78,000 and total cash on hand is $600,000. 

Mayor Weiss signed the Tax Warrant for 2014-2015.

REPORT FROM THE BOARD OF TRUSTEES
Mayor Weiss thanked everyone for their participation in the 4th of July festivities.  Mayor Weiss invited residents M.Madigan and N.Bagget to report on events scheduled for July 10th – Nikola Tesla’s Birthday taking place at the Tesla Center in Shoreham from 10-12 am and at the North Shore Public Library that evening. 
Mayor Weiss reported the Board’s plan to post the minutes of the Board meeting on the Village website and to institute “Town Hall meetings” to hear from residents.  Mayor Weiss stated that the Board will also schedule work sessions and special meetings to facilitate the enactment of proposed Village code and that his goal is for the laws to be in place by year-end.  Mayor Weiss stated that the Board was meeting with bond counsel to investigate obtaining a bond to finance roadwork.

Also discussed by Mayor Weiss was the following: a) the need for tree trimming along the roads; the possibility of forming a committee to investigate a cleanup and necessary repairs of the “Bridge”; that resident Melius and resident Kullen elected to discontinue their Village service as Building Inspector and member of the DRB; that many people have expressed an interest in being part of Village government; the new building permit application process; and the intent of the Board to review the proposed Comprehensive Plan.

Mayor Weiss introduced the formation of a Roads Committee consisting Commissioner Kogel (Chair), Bob Reid, Tony Aliperti, Michael Madigan (Green Infrastructure Committee “GIC” liaison) and Butch Guercia.  This committee would be in effect for 1 year subject to renewal as needed.  The committee’s directive would be to make recommendations on road and drainage for the entire Village including the beach ramp.  The committee’s recommendations should include input from the GIC and Parks Commissioner.  Recommendations would be for phasing of work, preparation of RFPs for engineering, awards of bids of engineering and contract work for Board’s approval.  The committee would coordinate with the Town of Brookhaven and the Suffolk County Water Authority and would oversee the work.

HEARING ON PROPOSED LOCAL LAWS

Resolution 16 – Tabling of hearings on proposed Local Laws: Steep Slopes, SEQRA, and DRB amendments

Motion to closed Regular Meeting and Open Hearing on Local Law 1 of 2014 – Extension of Moratorium on Subdivisions.
Approved.

Clerk Spier reported that notice of the hearing on the local law was published in the paper, posted on the Village bulletin board and website, and referred to the Town Clerk and the Suffolk County Planning Council “SCPC”.  Clerk Spier made the letter from SCPC finding the proposed local law a matter for local determination part of the record.  Clerk Spier reported that this moratorium would be in effect until December 2014 while the subdivision law was enacted.

Motion to close the Hearing and re-open the Regular Meeting.

ANNUAL MEETING RESOLUTIONS FOR 2014-15
Resolutions 1 - 11

BOARD OF TRUSTEES MEETINGS – OPEN MEETINGS LAW REQUIREMENTS
By Resolution 1 of July 2014 (attached) regular meetings will take place on the second Tuesday of each month at 7:30 PM and Work Sessions will take place as called on the second and fourth Tuesday of each month at 8:00 PM (if called).

ADVANCE APPROVAL OF CLAIMS
By Resolution 2 of July 2014 (attached) authorize payment in advance of audit claims for public utility services, postage, freight, and express charges.

ADVANCE APPROVAL OF VILLAGE BILLS
By Resolution 3 of July 2014 (attached) the Board of Trustees authorize the Village Treasurer to expend up to $55,000 for bills incurred for the period through July 1 - 31, 2014 for normal operating expenses subject to the Board’s final approval at its next regular meeting.

BANK SIGNATURE AUTHORIZATION
By Resolution 4 & 17 of July 2014 (attached) the Board authorizes the Mayor, the Village Treasurer and the following Village Trustees to be the official signors on the Accounts held by HSBC Bank USA for the Village of Shoreham to wit: Edward Weiss, Brian C. Vail, Kathleen Baumann Schnoor, Catherine Donahue-Spier.

DESIGNATION OF DEPOSITORIES
By Resolution 5 of July 2014 (attached) HSBC BANK was designated as the Village depository of all monies received by the Village.

APPOINTMENT OF VILLAGE OFFICIALS
By Resolution 6 of July 2014 (attached) a list of appointments were made by the Mayor and accepted by the Board of Trustees

MILEAGE ALLOWANCE
By Resolution 7 of July 2014 (attached) reimbursement for use of private automobiles on Village business by employees and officers was authorized at 56 cents a mile.

VILLAGE EMPLOYEE SALARIES
By Resolution 8 of July 2014 (attached) the Board set the salaries and/or hourly rates of Village employees including starting salaries.

DESIGNATION OF OFFICIAL NEWSPAPER
By Resolution 9 of July 2014 (attached) The Times-Beacon Record was designated as the official newspaper of the Village.

BOARD OF TRUSTEE MEETING RULES OF PROCEDURE
By Resolution 10 of July 2014 (attached) Rules of Procedure were adopted as a procedural guideline in the conduct of Village meetings.

ORGANIZATIONAL MEETING
By Resolution 11 of July 2014 (attached) the next annual organization meeting of the Village will be held on July 14, 2015.

COMMISSIONER REPORTS

Justice Court – Desmond
No report.

Code Enforcement – Flannery
No report.

Webmaster – Oberdorf/Falco
Commissioner Falco indicated that he would post whatever documents directed by the Board and would update the list of Village Officials upon receipt by the clerk.

Public Works– Kogel
Commissioner Kogel reported that the public works and roadwork portion of the beach access road was complete and that fencing and planting of the area would take place next.  Commissioner Kogel reported that planned work included the drain installation at Beatty Road, emergency curbing on Ashley Lane, and the cleaning out of the drains.   Pursuant to Trustee and resident input, Commissioner Kogel to notify residents by email of work to be performed on the right of way abutting their property and for the Roads Committee to develop a system for scheduled cleaning around the Village storm water drains.  Mayor Weiss indicated that he and Commissioner Kogel will inspect the areas where proposed work is to be done and that a system will be put in place for interaction between the GIC and the Roads Committee.

Building Department
No report.

Parks - Mahoney
No report.

Beach – J.Weiss
Reported that vehicles were getting stuck going up the beach access road.  The Mayor instructed the Roads Committee to confer with Commissioner J.Weiss regarding possible solutions to this problem.

Building Operations – Scrimenti
Reported that the spring/summer cleanup is in process and that interior painting will begin shortly.  Commissioner Scrimenti has obtained quotes for carpeting the LL and has turned information over to the house aesthetics committee for final review.

Building & Grounds - Blum
Reported that he will obtain a purchase order so that he can order parking lots light fixtures this month with fund allocated in his 2014-15 budget.

Recreation – BJ Richter
Requested that a description of the Recreation Commissioners responsibility be provided to her.  Mayor Weiss indicated that a definition of Village Commissioner responsibilities would be forthcoming.

Environmental/Storm Water Management - Emma

NEW BUSINESS
Suffolk County Police Officer Thomas Kennedy of the 7th precinct introduced himself and informed the Board that he was the community liaison between Shoreham Village and the Police Department.  He invited residents and officials to contact him with any questions or problems related to law enforcement and community concerns.  Email address: Thomas.Kennedy@sufffolkcounty.ny.gov.  Officer Kennedy also informed the Board of the existence and usefulness of NIXLE, a vetted media information source for police related activities.

A resident inquired as to the placement of surveillance video cameras in the parking lot of Briarcliff School and was informed that the Board will continue meeting with the school officials to discuss that and other issues related to the closing of Briarcliff School.

PUBLIC COMMENT
Resident Abata asked for and was provided with, by Building Commissioner Walker, the qualifications and experience of the newly appointed Village Building Inspector.
